This Statement outlines the terms and conditions governing all sales and purchases made through this website, regardless of whether the order was transmitted via the internet, telephone/fax or post. By accessing, browsing and/or using this site you acknowledge that you have read, understood and agree to be bound by these terms and to comply with all applicable laws and regulations. If you do not agree with these terms, do not use this site.
Anyone ordering products for delivery acknowledges they have reviewed the contents of their order and acknowledge that it contains acceptable and approved items for import into the country of destination/delivery. The buyer, solely, accepts the full risk of any items or package (or part thereof) being detained by customs for whatever reason , and acknowledges and agrees that they will not hold Harmonic industries liable for such packages, for whatever reason, being unable to be delivered to their destination.
Harmonics Industries Customers and Accounts. Some products available on this site maybe restricted in your country. It is your responsibility to comply with such restrictions. To purchase Harmonic industries products’ you must of legal age in your country. Any minors, who wish to use this site, must do so under the supervision of a guardian who agrees to be bound to the conditions of use. Any Harmonic industries account is to be used only by the person registered for that particular account. All information provided on registration must be true and accurate. False information provided on registration is considered fraud and is subject to the Business Consumer Act of 1993. The account holder is responsible for ensuring that their account details remain confidential, and that access to their computer remains restricted to prevent others from gaining access to their account. The account holder accepts responsibility for all activities which occur under their account. Harmonic industries reserves the right to refuse service, terminate accounts, or cancel orders at any time and will not be held responsible for fraudulent information.
PRICING All prices quoted are subject to change at any time at the discretion of Harmonic industries. You will be charged in the currency which you have chosen to shop. Harmonic industries reserves the right to reject any orders which include incorrect prices which may occur due to data entry errors, code errors, hacking, incorrect pricing provided by manufacturer, translation errors etc. Prices are not negotiable and unless marked with a 'Free Worldwide Delivery' symbol do not include postage and handling. Postage and handling costs will be calculated when completing the order.
SHIPPING We can send your order to virtually any country in the world. All our items are professionally packed for safe international delivery. You may also request that your order be gift wrapped free of charge. We ship all products by airmail or Express. This usually takes between 4 and 15 working days depending on the delivery service in the destination country.
We normally ship our products within three business days unless specified otherwise in the item description. If we are unable to dispatch your order within three business days we will contact you and advise you of the expected dispatch date.
Your order will be delivered in separate parcels of less than 20kg (around 44 pounds) each for ease of handling and shipping. Our shipping & handling rates are based on the weight of the total order. Products which may exceed the size or weight restrictions of NZ Post will require a special quote which will be calculated and e-mailed within 1 working day.
Our products are delivered with free insurance when you purchase from Harmonic industries. In the highly unlikely event that your item arrives damaged, or is lost, let us know, and we will either replace it (if a replacement is available) or issue a refund - the choice is yours. This will be pending approval of claim from the freight company. In cases, where the freight company requires you to fill a form and mail back to them about notification of non receipt or damage goods, the claim will be processed after that form is received by the freight company.
Any import duties or taxes, which are levied by the authorities of your country once the product reaches your country, are at your cost.
Please check your delivery address carefully as we will not be responsible for delivery to an incorrect address. The customer shall be responsible for the cost to resend a parcel that is returned because of an incorrect address. There is no track and trace for items sent by standard post, hence there is no proof of posting.
ONCE YOUR ORDER HAS BEEN SHIPPED YOU ARE NOT ABLE TO CANCEL YOUR ORDER.
PAYMENT Payment options provided by Harmonic industries are Visa, MasterCard, Amex, Diners, Money Order, Check/Cheque, Direct Credit, Internet banking (not available in all countries) Your credit card will be billed when you confirm your order.
Cheques can be either personal or bank draft, and are to be made payable to: Harmonic industries in the currency of your country. Please post to our address. All cheques will require to be 'cleared' by the bank before goods can be dispatched. This may require 10-15 days.
OWNERSHIP When your order is delivered, you acquire ownership of all items. Harmonic industries will no longer be responsible for any damage inflicted on the items unless it is due to a manufacturing fault and is covered under warranty.
RETURNS POLICY If an order is not received or if an item is received and it is either damaged or faulty, a return claim MUST be filed with Harmonic industries within 30 days from date of despatch of goods. Email details of your claim to harmonics@ihug.co.nz. There will be an investigation process and if it leads to a satifactory conclusion and proof of fault as claimed, then a Return Material Authorisation (RMA) number will be allocated and the faulty goods can then be returned. If a replacement or refund is required due to product not to the liking of the recipient or not as expected, other than a change of mind, then the return shipping and other charges will be borne by the recipient and refund will be processed less initial shipping fee only after the goods are received by us in original condition.
The following options will be made available:
Replacement: If a replacement is required it will be sent subject to availability, at no charge.
Credit: If a credit is required, the appropriate Harmonic industries account will be credited to the amount of the transaction, in the currency at the time of purchase.
Refund: If a refund is required, it will be provided according to the original payment (i.e. if payment was made on Visa, the visa will be credited.
Returns are not accepted due to a change of mind, so please choose carefully. Exchanges will not be permitted.
LICENSE AND SITE ACCESS
Access to the Harmonic industries website is granted only for the purpose of accessing the services provided. Under no circumstances may any individual alter any part of the website. No part of this site may be reproduced for any reason, nor may any parts of the site be displayed anywhere apart from Harmonic industries unless written permission has been granted by Harmonic industries limited including logos, trademarks, or registrations. You are granted access to Harmonic industries under the condition that you will not interfere, or attempt to interfere with any of the content.
LIMITATION OF LIABILITY
UNDER NO CIRCUMSTANCES, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE, SHALL HARMONIC INDUSTRIES BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF DATA OR PROFIT, ARISING OUT OF THE USE, OR THE INABILITY TO USE, THE MATERIALS ON THIS SITE. IF YOUR USE OF MATERIALS FROM THIS SITE RESULTS IN THE NEED FOR SERVICING, REPAIR OR CORRECTION OF EQUIPMENT OR DATA, YOU ASSUME ANY COSTS THEREOF.
LAW AND JURISDICTION
These Terms and any matter relating to this Site will be governed by New Zealand law and the New Zealand courts shall have non-exclusive jurisdiction in respect of them.
